Virtually every exterior project requires that an application be submitted and approved in advance. This includes all exterior construction, improvements, remodeling or modification on or to a lot including noticeable landscape changes.
Our Covenants, Conditions, and Restrictions (CCR's) and the Grande Pointe Design Code set requirements for construction and landscaping to ensure the architectural integrity and natural landscape characteristics of the neighborhood. Our development philosophy is driven by the commitment to design quality ensuring that materials are best used to enhance the natural beauty. In all instances, the Association has a strong determination and desire to create a superior living environment for generations to come through the preservation of the natural character of the community.
There are examples of lawns, fences, windows, driveways, etc. that are non-compliant with the Grande Pointe Design Code. Fortunately, there are not that many, and for those improvements with a lifespan like fences, landscaping, paint colors, etc., those will be required to follow the guidelines when these improvements are at end-of-life and require major repairs or replacement. The main reason these non-compliant improvements exist is because of builders over the years acting as 'declarant' choosing not to consistently follow the governing documents. Since ownership took control of the HOA in 2019, the ARC and Board of Directors have been and are bound to follow our CCR's and our Design Code.
If the project (construction or landscaping) ends up being compliant with the Design Code, most likely, nothing happens. However, there are nuances with almost every project ranging from gutters to decks to simple landscape alterations, and the odds that an owner might miss something are pretty good. If an owner adds or modifies something that doesn't meet the guidelines, they will most likely have to remove it or alter it. It is a lot easier and less stressful to all when an application is submitted.
The architectural committee consists entirely of volunteers who cannot always respond immediately, and because of the volume and complexity of some applications, it takes a week for the committee to review and prepare questions. To accelerate the process for owners, we hold a meeting every three (3) weeks instead of every four (4) weeks as specified in the governing documents.

The county is concerned primarily about structural issues while the Grande Pointe Design Code is more concerned about architectural aesthetics and maintaining the natural beauty of the neighborhood.

It is not a requirement that an owner call-in or dial-in to a meeting when their application is being reviewed. But, if possible it is very helpful and can make the approval process go faster.
To request a variance, an owner can complete a Variance Request Form. Variances may be granted for a qualified disability under the American Disability Act (ADA), or if the Design Code requirement conflicts with local, state or federal laws and statutes, or if the Design Code creates an unnecessary hardship created by conditions peculiar to the lot. If there is some level of necessary hardship and inconvenience shared by all of the community, and if other lot owners bear the same stated hardship, then the hardship is not justification for a variance.
